Florida man faces DUI Manslaughter charges after New Year's Day crash


A 59-year-old man has died in a crash that happened just before 5 a.m. Tuesday.

David Shepherd from Ponce De Leon, Florida, was driving southbound on Florida State Road 81 when his vehicle was struck by a 2008 Toyota Tocoma travelling in the northbound lane.

While cresting the hill, the driver of the Toyota -- identified as 22-year-old Trevor Burgess of Westville, Florida -- failed to stay in the northbound lane, hitting the front of Shepherd's car head-on.

The Toyota ended up overturning, coming to a final stop on its roof and catching fire.

Burgess had minor injuries. The 23-year-old passenger in Burgess's car is in critical condition at Fort Walton Beach Medical Center. According to the accident report by Florida Highway Patrol, the passenger was not under the influence of alcohol.

Shepherd died as a result of his injuries from the crash.

Burgess faces one count of DUI manslaughter and one count of DUI Serious Bodily Injury.
